1. Definitions

"Service" refers to the vehicle rental services provided by phodomy. "User," "you," or "renter" refers to any individual who submits an inquiry, makes a booking, or rents a vehicle through phodomy. "We," "us," or "our" refers to phodomy, registered at 15 Bùi Viện, Phạm Ngũ Lão, Quận 1, Hồ Chí Minh 70000, Vietnam. "Vehicle" refers to any car in the phodomy fleet made available for rental. "Agreement" refers to the rental contract signed at the time of vehicle pickup.

2. Acceptance of Terms

By using our website, submitting an inquiry, or entering into a rental agreement, you accept and agree to be bound by these terms and conditions. If you do not agree, please do not use our services. You must be at least 21 years of age and hold a valid driving license and International Driving Permit (where applicable) to rent a vehicle from us.

3. Service Description

phodomy provides self-drive car rental services in Vietnam. Our fleet currently includes compact hatchbacks, midsize sedans, and off-road SUVs. Vehicle availability varies based on demand and maintenance schedules. We reserve the right to offer a comparable substitute if the originally booked vehicle is unavailable, with prior notice to the renter.

4. Booking and Confirmation

Submitting a contact form constitutes an inquiry, not a confirmed booking. A booking is confirmed only after you receive written confirmation from our team and the required deposit has been received. We may decline a booking at our discretion if we determine that the requested vehicle is not suitable for the stated itinerary or if documentation is incomplete.

5. Renter Responsibilities

As a renter, you agree to operate the vehicle in accordance with Vietnamese traffic laws and the terms of the rental agreement. You must not allow unauthorized persons to drive the vehicle, use the vehicle for illegal purposes, drive under the influence of alcohol or drugs, leave the vehicle unattended in unsafe locations, or exceed the agreed mileage without prior arrangement. You are responsible for all traffic fines, tolls, and parking fees incurred during the rental period.

6. Payment Terms

Rental rates are quoted in Vietnamese Dong (VND). A deposit is required to confirm a booking, with the balance due at the time of vehicle pickup. We accept cash and bank transfer. Credit card payments may be available subject to processing fees. If the rental period is extended, additional charges will be calculated at the applicable daily rate and must be settled before or upon return.

7. Insurance and Liability

Each vehicle class includes a specified level of insurance coverage. The renter is responsible for any damage not covered under the insurance terms, including damage resulting from negligence, unauthorized off-road use (for vehicles not designated as off-road capable), or violation of traffic laws. The renter is liable for the insurance excess (deductible) in the event of a claim. Full insurance terms are provided at the time of pickup.

8. Vehicle Condition and Return

Vehicles are provided in clean, roadworthy condition with a full fuel tank. A pre-rental inspection is conducted jointly at pickup, and any existing marks are documented. Upon return, the vehicle must be in the same condition as received, with a full fuel tank. Failure to return with a full tank will result in a refueling charge. Late returns incur additional daily charges and must be communicated in advance where possible.

9. Cancellation and Refund

Cancellations made at least 72 hours before the scheduled pickup receive a full deposit refund. Cancellations within 72 hours may forfeit up to 50% of the deposit. No-shows without prior communication forfeit the full deposit. Refunds are processed to the original payment method within 10 business days.

10. Intellectual Property

All content on the phodomy website — including text, images, design, and branding — is owned by phodomy and protected under Vietnamese intellectual property law. You may not reproduce, distribute, or use any content from this website without our written permission.

11. Disclaimers

phodomy provides vehicles "as is" based on their class specifications. While we maintain our fleet diligently, we do not warrant uninterrupted or fault-free operation. We are not liable for delays caused by traffic conditions, road closures, weather events, or other factors beyond our control. Route advice provided by our team is informational and does not constitute a warranty of road conditions.

12. Limitation of Liability

To the fullest extent permitted by law, phodomy's total liability for any claim arising from the rental agreement shall not exceed the total rental fee paid. We are not liable for indirect, incidental, or consequential damages including loss of income, travel costs, or personal inconvenience.

13. Termination

We reserve the right to terminate a rental agreement and repossess the vehicle if the renter breaches any of these terms, provides false documentation, or uses the vehicle in a manner that endangers public safety. In such cases, no refund of the rental fee will be provided.

14. Dispute Resolution

These terms are governed by the laws of the Socialist Republic of Vietnam. Any disputes arising from these terms or the rental agreement shall first be resolved through informal negotiation. If negotiation fails, disputes will be submitted to the competent courts in Hồ Chí Minh City, Vietnam.

15. General Provisions

These terms represent the entire agreement between you and phodomy regarding vehicle rental. If any provision is found to be unenforceable, the remaining provisions continue in full effect. Our failure to enforce any right under these terms does not constitute a waiver of that right. We may assign our rights under this agreement; you may not without our written consent.

16. Changes to Terms

We may revise these terms at any time. Changes become effective upon posting to this page. Continued use of our services after changes constitutes acceptance of the updated terms. We recommend reviewing this page before each booking.
